A marriage-based immigrant visa allows a U.S. citizen or green card holder to sponsor their spouse to live in the United States as a permanent resident. This process classifies the spouse as an immediate relative, which is the highest priority category in the U.S. immigration system.
On the other hand, a K-1 fiancé visa is a nonimmigrant visa that allows a U.S. citizen to bring their fiancé(e) to the United States to get married within 90 days of arrival and then apply for a green card through adjustment of status.
We generally prefer the marriage-based route because it offers more protection and fewer complications, especially under current policies.
For example, under the June 2025 U.S. travel ban, nationals of 19 countries are barred from entering the United States or receiving visas. However, there are important exceptions.
